1) Our general terms and conditions
(hereinafter “GTC”) apply to all products and orders on our website www.my-hy.de (hereinafter “online shop”) as well as for the entire product range of Hauthelden GmbH, Hauptstraße 63, 15377 Buckow / Märkische Schweiz, email: info@hauthelden.de. 2) Additional conditions or conditions that differ from these terms and conditions require our written consent
2) Conclusion of the Contract
The presentation of our products in our online shop does not constitute a legally binding offer to conclude a purchase contract. Orders for our products can be made using the order template at www.my-hy.de. Orders deviating from this require our written consent. You can view, correct, or delete your entries during the entire ordering process in our online shop. You only submit a binding offer to purchase when you click the “binding order” button. You will then receive a confirmation of receipt by email, in which your order is documented again. However, this e-mail only confirms receipt of your order and therefore does not constitute acceptance of your offer. Only when we have received the separate “order confirmation” email do we confirm that we have accepted your order and the contract is legally concluded. A contract is expressly not concluded if the goods you have ordered cannot be delivered. In this case, we will inform you immediately and reimburse you for any consideration already received. The contract language is German. The Hauthelden GmbH will save your order data after the conclusion of the contract within the framework of the legal provisions, but not make them accessible online. Upon request, we will be happy to send you a copy of your order details by email. To do this, please send a short message to info@hauthelden.de. 3) Right of Withdrawal and Cancellation Policy
You can cancel your order in writing within a 14-day period without giving reasons. The period begins with the delivery of the goods to you or to a third party named by you who is not the carrier. To meet the deadline, it is sufficient to send the cancellation or the goods on time. You can find a corresponding cancellation form at www.my-hy.de under Forms. However, an email is sufficient. The revocation must be sent to: Hauthelden GmbH Hauptstrasse 63 15377 Buckow or by email to widerruf@hauthelden.de After receipt of your revocation and receipt of the goods, we will refund the payments already received. The customer bears the shipping costs for the return. Goods that have been produced or already used according to customer specifications are excluded from the cancellation.
4) Retention of Title
The goods remain the property of Hauthelden GmbH until they have been paid for in full.
5) Delivery
The goods are shipped by DHL or Hermes shipping. The delivery time within Germany is up to seven working days from the receipt of our order confirmation. The first delivery is only made after prepayment or direct debit. Packing stations are not supplied. The packaging of the goods may differ from the images in the online shop.
6) Prices and Shipping Costs
The price list stored on our website at the time of your order applies to your orders. Our prices include the currently applicable sales tax and plus the respective shipping costs. 7) Defects and Transport Damage
The delivery must be checked for completeness and intactness immediately upon receipt. Transport damage must be reported to the deliverer directly upon acceptance of the shipment and confirmed by him, otherwise, we cannot provide any compensation through transport insurance. The goods must also be checked for obvious defects upon receipt. Defects in the goods must be reported to us immediately and will be replaced immediately or the purchase price will be reimbursed. We exclude further claims for compensation, especially in the case of damage caused by improper use or storage of our products.
8) Payment
All invoices, unless paid in advance, by credit card or cash on delivery, are payable within 14 days of receipt of the goods or the invoice without deductions. If the payment deadline is exceeded, the customer bears interest on arrears, regardless of other claims. Payments withheld due to counterclaims or offsetting of the customer’s claims are not permitted, unless these are undisputed, legally established, or agreed in writing. After unsuccessful reminders for unsettled claims, we will hand them over directly to a debt collection company. Subsequent deliveries to a customer with payment defaults will only be carried out after the outstanding liabilities have been settled.
9) Reservation of Title
The delivered goods remain our property until the purchase price has been paid in full
10) Data security
Personal data from your order will be treated with strict confidentiality and will not be passed on to third parties. We use the secure encryption technology SSL (Secure Socket Layer) for the transmission of data. Data is encrypted and exchanged between your browser and our server
11) Place of Jurisdiction
The place of performance is Buckow and the place of jurisdiction is Strausberg. The contractual relationship is subject exclusively to German law. International sales law does not apply. Our sales tax identification number is: DE 309515696 and our tax number is: .064 / 107/04585 at the Strausberg tax office
12) Dispute Resolution
In principle, in the event of a dispute, we are ready to find an amicable out-of-court solution. However, you can also use the European Commission’s platform for online dispute resolution at http://ec.europa.eu/consumers/odr/
13) Final provision
In the event that one or more conditions of these terms and conditions are legally ineffective in the opinion of a court, the effectiveness of the remaining provisions remains unaffected. In place of the ineffective regulation, the statutory regulation will apply. The use, duplication, or imitation of the content and images in our online shop require express written approval from Hauthelden GmbH Deutschland GmbH.
